​HIRING TERMS & CONDITIONS

CONDITIONS OF HIRE
By hiring from Beyond the Pines Boat Hire (BTP), the hirer acknowledges that they have read, understand & agree to be bound by these terms and conditions which constitute a Rental Agreement.

PERSON IN CHARGE OF THE VESSEL
The boat must be controlled at all times by the listed driver(s) that require a valid boat license and must be 21 yrs or older. A valid driver’s license is required in case of towing the vessel. Confirmation and sighting of the hirers’ identification will be required. Any other passenger wishing to drive the vessel will also be required to present a valid boat license and must be at-least 21 years old. The hirer will NOT allow any other person to control the boat unless their details are listed and verified with BTP. The driver(s) is(are) responsible for all occupants and their actions. All marine licensing rules apply.

LIABILITY
BTP is not responsible for any loss of personal items, injuries or deaths to the hirer or its passengers.
HOURS OF OPERATION
Operating the boat is only permitted during daylight hours, unless approved.

PERMITTED WATERS
Boats are allowed in partial smooth inshore waters ONLY. The boat is not to operate in non-smooth water (at sea) AT ANY TIME. Boats are not permitted to cross coastal bars AT ANY TIME.

WEATHER
The hirer must not operate the boat in poor weather or sea/river conditions or where such conditions are imminent. If poor weather or sea/river conditions become apparent during a reservation, it is advised for the hirer to return the boat to place of pickup for their own safety and that of all passengers and the boat. Refunds cannot be issued once a reservation has started due to weather changes. WEATHER FORECAST MONITORING IS THE RESPONSIBILITY OF THE HIRER TO ENSURE SAFETY OF PERSONS ON BOARD THE BOAT.

AGREED RETURN TIME
Should the boat not be returned within the agreed time stipulated and the hirer has not communicated with BTP, additional costs may apply for a late return. Police may be called if the boat is not returned as per the agreement. Please communicate at all times with BTP if plans change for any reason.

PENALTIES
The hirer must pay penalty notices if issued by any Authority, occurring during the hire period whether on the road or in the water.

DOCKING POLICY
When docking the boat at a wharf or pontoon, all care must be taken to avoid scratches, dents and damage to boat. Please use fenders provided to protect the sides of the boat. Any damages will need to be paid for.

DAMAGE TO THE VESSEL
The hirer must pay for any damage or losses caused to the boat/equipment during the hire period. The hirer agrees to pay the owner the cost of repair; replacement of any loss or damage howsoever caused which is not covered by insurance due to any breach by the hirer.

ABIDING BY ALL LAWS
Hirers will abide by all Maritime Authority, marine and environmental legislation, including being responsible for any fishing license if required. It is the responsibility of the Hirer to ensure they have a valid driver’s and/or boat license. Any listed Hirer must not drive the vessel whilst under the influence of liquor or drugs, or with a blood alcohol content in excess of any statutory limit. The hirer WILL accept the consequences if he/she or any listed co-driver breach these conditions and will not be covered by insurance if found to be in breach of the conditions.

PAYMENT AND REFUNDS
Bookings are only confirmed when payment has been received in full. A full refund will be issued for cancellations made up to 5 (FIVE) DAYS in advance of the booking date. A 50% refund will be issued for cancellations made up to 2 (TWO) DAYS in advance. No refunds will be issued for cancellations made less than 2 (TWO) DAYS before the booking date, except in exceptional circumstances. For example, cancelling on Jan 1st for a booking on Jan 3rd will get a 50% refund, cancelling on Jan 2nd will not be refunded.

FULL-TO-FULL FUEL POLICY
BTP has a FULL-TO-FULL fuel policy. This means that you MUST return the fuel tank(s) full or we will charge you $3.00 per litre for any fuel used during your hire in addition to the daily rate. You may refill the tanks yourself using 95 or 98 petrol to avoid this charge. Refilling with 91 or E10 may damage the motor for which you will be liable.

WEATHER/MECHANICAL DISCLAIMER
We reserve the right to cancel any booking due to dangerous swell and wind conditions at our discretion, at any time. In the case of dangerous conditions, a rescheduling will be provided. We reserve the right to cancel any booking due to any mechanical issues with a vessel, at any time. In the case of mechanical issues, a rescheduling will be provided.

COVID-19 POLICY
Any Public Health Orders in effect at the time of your booking must be followed. Where you or one of your passengers is a close contact or is infectious with COVID-19 and must self-isolate. We are not held liable for any fines that may be incurred for failing to follow any rules.

AGREEMENT TO TERMS
By hiring from BTP, the hirer acknowledges that they have read, understand & agree to be bound by these terms and conditions of this rental agreement. Further, they agree that they have made them-self familiar with the location & content of the safety management plan and operating manual and understand these documents. The location of all safety equipment and procedures to follow for any emergency or hazard are located within these documents.
